The Board has provided the Indiana public school teachers the opportunity to select their exclusive bargaining representative through an election process that guarantees to each teacher an equal opportunity to be represented by any employee organization, including a rival union. Ind. Code §§ 20-7.5-1-3(a), 20-7.5-3-1(3). The Board may not by its own regulations grant an exclusive bargaining representative access to means of communication, however, unless such access is also granted to any other employee organization, provided that the equal protection and First Amendment interests of the teacher members of the bargaining unit is not infringed.
The Court of Appeals upheld the Board’s regulation prohibiting PEA from using the BPS interschool mail system on the ground that the regulation was a reasonable effort by the Board to protect the First Amendment rights of teachers by granting access to the regulated communication systems only to a representative chosen through the election process.
Because PEA has a first amendment right to use the BPS interschool mail system, the Board cannot grant PEA different access rights. The Board may, however, forbid PEA from using the interschool mail system, because an alternative to the mail system is available that does not discriminate against the views of PEA. d2c66b5586
